What do you do when your boss breaks the contract?

My boss had me sign a commission structure when i was hired. as i have become more successful and bringing in more business, she is changing the rules and not paying the commission that is due to me. i like the job, i can live on the salary without commission, but i work hard to bring in the clients. the commission is a great motivation. i've confronted her about it, and she makes up excuses, none of which i consider valid. any suggestions on what to do?

  3. If the contract is binding, you have a case against her but it doesn't sound like you want to sue. I have to tell you that since she has broken the contract, it is no longer binding. You should go to a lawyer and have him evaluate your situation. Make sure you have full documentation over anything that is affected by this contract and the breaking of it. You can use this to your advantage however. Your boss owes you money and sounds like she owes you thanks for building the business as well. Ride this. The next time you bring in a client, break down what will be due to you from that clients work and give the estimate to your boss on paper. This isn't a new contract but a reminder to her that you are keeping track of the moneies. You might have to do this a few times, making sure you keep your own copies. If she doesn't pay, you are beating a dead horse so use your leverage, tell her you will quit if she doesn't pay you (make sure you have an exact sum) by ------ date. Remind her of the contract and keep your cool. Be matter of fact like. If she fires you, that is the cherry on top of your sundae. It might take awhile to get your money but you do have a case and at least the amount wont be growing. Sounds like you can have your own company. As long as you didn't sign any non compete contract, go on your own! Good Luck to you and yours.
  4. Sounds like you're in the right place to sue, but it doesn't really look like that option is very appealing to you. But you might want to fully confront your boss, letting her know you are in the right position to sue. That may throw her into a position where she knows something has to change if you are going to stick around.
