Could I sue Costco Tire Center? (Or get money back on 4 tires)?
So I have a 2004 Subaru Forester and it was time to get my tires changed. I decided to get my tires changed at Costco Tire Center. They had a great deal (4 tires for $400). A month after I changed my tires, I was on the highway to go to work. All of a sudden I lost control of the wheel and noticed that my tire was flat. The lanes were all full and I was driving about 65 mph with a flat tire. A few seconds later I pulled over. I noticed that my front left tire was flat. I called my dad and he put in a spare. He noticed that the tire itself was not damaged, it was the tire balance that was wrong. He suspects that the people at Costco did not check properly. I am thinking about going to Costco and complaining to them. Hopefully I will get my $400 back. I almost lost my life on the highway, if it wasn't for that emergency stop. Do you think I can get my money back? Is this worth going to court for? I would like to know...! This happened today, and no it fine up until today. I was driving on the highway and I heard a "POP" and then my tire went flat... I pulled over and called my Dad. He said that the tire was not punctured or anything. My dad said that they did not balance the tire correctly. I could not control the vehicle when the tire went flat. How should I solve this..?

- What do you mean by " it was the tire balance that was wrong " ??? How can anyone tell if the tire was not balanced correctly when its flat plus if it was incorrectly balanced then you would have felt the shake in the vehicle... No you can get the tire check and or replaced but you cannot sue anyone, this is what "Road Hazard Warranty will cover".. Not to sound disrespectful but what you dad is saying makes no since, if the tire was in anyway incorrectly mounted you would have had issues as soon as you drove off.. What most likely happened is that you hit something on the road or you ran over something without knowing and this may have pop the tire, just take it back and have them recheck everything and do as I stated above but you cant sue them..
- Sure. Get you money back, just return the tires and buy them some where else.
- 1. Your father is wrong. Being improperly balanced does not make a tire go flat. 2. If the tire was not balanced properly, you should have noticed immediately that the car was not handling correctly. 3. Even if Costco was responsible, since you did not actually crash, the only damage was the cost of fixing the flat tire. If Costco was responsible, they should pay for the cost of reinflating the tire and rebalancing it. Courts do not award money for anything that "almost" happened, but did not. 4. If all four tires were balanced incorrectly, then they should rebalance the other three tires correctly or pay for the cost of doing so somewhere else. They should not refund any portion of the cost of the other three tires, except the cost of balancing them. 5. If three tires were balanced correctly and only one was not, then they should refund only the cost of balancing the incorrectly balanced tire (and the cost of reinflating it) and not any part of the cost of the other three.
- Sorry, your dad doesn't know what he is talking about. After a month of driving on the tire, something certainly happened to loose tire pressure thus causing the"Pop". Costco includes a road hazard warrantee and free lifetime balancing. If the tire is not repairable, they will pro-rate the tire value for a new one. I recommend having them pro rate two tires and replace a pair.
